This agreement is between you and SoulTweaks ("SoulTweaks", "we", "us", "our"), the Australian business that makes and publishes Soul Tune. It covers the Soul Tune app and its installer ("the Software"), your Soul Tune account, the Free and Premium plans, and the website soultune.cc. The same terms are published at soultune.cc/terms.html.

Please read it before you install the Software. By installing or using the Software, creating an account or buying a plan, you agree to these terms. If you do not agree, do not install or use the Software. If you are under 18, a parent or guardian must agree to these terms for you.

Nothing in this agreement takes away your rights under the Australian Consumer Law or any other consumer law that applies to you and cannot be excluded (see section 12).

1. Who we are

SoulTweaks is the trading name of the business that makes Soul Tune. We are based in Australia. Contact us at support@soultune.cc or on the Soul Tune Discord (linked from soultune.cc).

2. Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software on a PC you own or control, for as long as you keep to this agreement. Which features you can use depends on your plan (section 4). The Software is licensed, not sold: we (and our licensors) keep ownership of it. You must not:

  1. sell, rent, lend, share, sublicense or redistribute the Software, your account or a licence key;
  2. remove, bypass or tamper with the sign-in, the licence check or the one-PC rule;
  3. reverse engineer, decompile or modify the Software, except where the law allows it despite this term;
  4. use the Software to break the law or to harm other people's computers.

3. Your account and the one-PC rule

  1. Soul Tune asks you to sign in with a free account (email and password), made in the app or on the website.
  2. Each account, Free or Premium, works on one PC at a time. The first time you sign in on a PC, the account is locked to that PC's hardware ID: one-way scrambled (hashed) codes made on your PC from the motherboard's serial number, the firmware's UUID and Windows' machine ID. We never receive the serial numbers themselves. The hardware ID survives a Windows reinstall and changing the graphics card, drives or memory; a new motherboard or a new PC counts as a new PC.
  3. To use the account on another PC, sign in there and choose "Move my account to this PC". You can do this yourself once every 30 days. If you need to move sooner (for example, a motherboard failed), contact us and we will help.
  4. Keep your password private. You are responsible for what happens on your account unless it was used without your permission and you tell us promptly.
  5. Use an email address you can read: we send password-reset codes and notices about your plan to it.

4. Plans

  1. Free costs nothing and has no time limit.
  2. Premium is sold as Premium Monthly (billed every month), Premium Yearly (billed every year) and Premium Lifetime (paid once). All three unlock the same features, for one PC. The current prices and what each plan includes are shown at soultune.cc/#pricing. Prices are shown in US dollars; the checkout shows the final price in your currency, including any GST, VAT or sales tax, before you pay.
  3. "Lifetime" means for as long as SoulTweaks offers Soul Tune, with every update we release in that time. It does not mean your lifetime or the life of your PC. See section 16 for what happens if we stop offering Soul Tune.
  4. We may add, improve or move features between plans over time. We will not take a major feature away from a paid plan during a period you have already paid for; if we must (for example, for legal reasons), we will refund the unused part of that period, or for Lifetime, offer you a fair refund.

5. Payment (Polar)

Payments are handled by Polar (polar.sh), which acts as the merchant of record: Polar sells the plan to you on our behalf, takes the payment, charges any tax that applies, sends your receipt and processes refunds. Polar's own terms also apply to the payment. Your licence to use the Software is granted by SoulTweaks under this agreement.

6. Subscriptions (Monthly and Yearly)

  1. Monthly and Yearly plans renew automatically at the end of each period, and Polar charges the card or payment method you used, until you cancel.
  2. You can cancel any time, in Polar's customer portal (linked as "Manage your plan" on soultune.cc and in your receipt email) or by contacting us. After cancelling, Premium stays on until the end of the period you have paid for, then your account goes back to Free. Nothing Soul Tune has changed on your PC is undone.
  3. If we change the price of a plan, we will email you at least 30 days before the new price applies to your next renewal, so you can cancel first if you wish.

7. Refunds

Our refund policy is at soultune.cc/refund.html and forms part of this agreement. In short: payments for Premium plans, including renewals, are non-refundable, and we do not give refunds for a change of mind. This does not affect your rights under the Australian Consumer Law (section 12) or the refunds this agreement promises in sections 4, 16 and 17. Any refund is paid by Polar to the original payment method, and when a payment is refunded, Premium ends on that account straight away.

8. Checks and offline use

Soul Tune checks your account with our licence server when it opens. Between checks it works offline for up to 7 days on Monthly and Yearly plans, and up to 30 days on Free and Lifetime. If it cannot check in time, it asks you to connect to the internet; the undo functions keep working regardless.

9. What the software does

The Software changes Windows settings (the registry, services, scheduled tasks, power plans and boot configuration) and, on the pages you choose to use, network, graphics card, processor, memory and BIOS/UEFI settings. These changes affect how your computer runs. The Software creates a System Restore point and records every change so that it can be undone, and it skips changes that do not suit the hardware it detects. However, no tool can foresee every combination of hardware, firmware, drivers and software, and results differ from PC to PC. We do not promise a particular gain in frame rate or latency.

10. Your responsibilities

You are responsible for:

  1. keeping backups of your data before applying changes;
  2. reading the description and warnings of each change before applying it, in particular the Extreme level, the playbook and the graphics card, processor, memory (RAM) and BIOS pages;
  3. making sure the changes you apply are allowed by the terms of the games, anti-cheat systems and services you use;
  4. keeping your BitLocker recovery key available before making BIOS changes.

11. Updates

We may release updates that fix problems, change features or add new ones. Some updates reach Premium users first. To keep your account working, you may need to install updates that change how sign-in or the licence check works. These terms apply to every update unless the update comes with different terms.

12. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. Nothing in this agreement excludes, restricts or changes those guarantees, or any similar right you have under the consumer law of the country where you live.

13. Warranty and liability

  1. Apart from the guarantees in section 12 and any other rights that cannot be excluded by law, the Software is provided "as is". To the extent the law allows, we give no other warranty, express or implied, including that the Software will improve your computer's performance, that it is free of errors, or that every change can be undone in every situation.
  2. To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of data, loss of profits, game or service account suspensions, or hardware damage, arising from the use of or inability to use the Software, except to the extent the loss was caused by our failure to comply with a consumer guarantee or by our negligence.
  3. To the extent the law allows, our total liability to you under or in connection with this agreement is limited to the amount you paid for Soul Tune in the 12 months before the claim (or, for Lifetime, the price you paid).
  4. Nothing in this agreement limits liability that cannot be limited by law.

14. Third-party components, services and trademarks

The Software includes third-party components licensed under their own terms, listed in THIRD_PARTY_NOTICES.txt; those terms apply to those components. Some features download software from its maker (for example, graphics drivers or Windows tools) at your request; that software comes under its maker's terms. Soul Tune is not affiliated with or endorsed by Microsoft, NVIDIA, AMD, Intel, any motherboard maker, or any game publisher or anti-cheat maker. Their names are trademarks of their owners and are used only to describe compatibility.

15. Privacy

Our privacy policy at soultune.cc/privacy.html explains what we collect (your email, a hashed password, your PC's hardware ID and name, your plan and sign-in times), why, who processes it for us, and how to see, correct or delete it.

16. Ending this agreement

  1. You can stop using the Software at any time. Use the Software's undo functions before you uninstall it if you want your settings back. You can ask us to delete your account at any time.
  2. We may suspend or close an account that is shared, used to bypass the one-PC rule or the licence check, used with a stolen payment method, or otherwise used in serious breach of this agreement. Where the problem can be fixed, we will tell you first and give you a reasonable chance to fix it.
  3. If we close a paid account when you have not breached this agreement, we will refund the unused part of your paid period (or, for Lifetime, offer you a fair refund).
  4. If we stop offering Soul Tune altogether, we will tell you by email at least 90 days beforehand and refund the unused part of any Monthly or Yearly period.
  5. When this agreement ends you must stop using the Software, but you may still use its undo functions to restore your settings. Sections 12, 13 and 18 continue to apply.

17. Changes to these terms

We may update these terms, for example when we add features or the law changes. The current version is always at soultune.cc/terms.html with its date. If a change materially affects a paid plan, we will email you at least 30 days before it applies. If you do not accept the change, you can cancel before it applies and we will refund the unused part of any period you paid for in advance.

18. Governing law

This agreement is governed by the laws in force in Australia. Each of us submits to the non-exclusive jurisdiction of the courts of Australia. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country.

19. General

If any part of this agreement cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. We may transfer this agreement to a business that takes over Soul Tune, and we will tell you if we do; your rights under it will not be reduced. This agreement, the refund policy and the privacy policy are the whole agreement between us about Soul Tune.
